Terms of Sale

These terms apply when you buy a subscription to PKD Pro Tools or a digital download (such as the PKD M&E Calc Pack) from www.peterkdesign.co.uk. Please read them with our Terms of Use, which cover the licence, intellectual property and engineering disclaimer for the Tools.

1. The seller

2. Products

  • PKD Pro Tools subscription – access to our members-only online calculation tools for as long as your subscription is active, including new tools and updates we add.
  • Digital downloads – files such as spreadsheets and scripts, licensed for use as described in the Terms of Use.

Product descriptions explain what each product does. Tools may be updated or improved over time.

3. Prices and payment

Prices are shown in pounds sterling at checkout and include any VAT that applies. Payment is taken at the time of order through our payment providers. A contract is formed when we confirm your order by email.

4. Subscriptions

  • Subscriptions are billed monthly or yearly in advance and renew automatically at the end of each period until cancelled.
  • You can cancel at any time from your account or by emailing us. Cancellation stops the next renewal; you keep access until the end of the period you have paid for. We do not refund part periods, except as set out below or where the law requires.
  • We will give at least 30 days’ notice of any price change, which will apply from your next renewal. You can cancel before then if you do not wish to continue.

5. Your right to cancel (consumers)

If you are buying as a consumer, you normally have 14 days to cancel a contract for digital content or services. However:

  • Digital downloads: by starting the download, you agree to immediate supply and acknowledge that you lose the right to cancel once the download begins.
  • Subscriptions: by accessing the Tools within 14 days, you agree to immediate supply. If you cancel within 14 days of first subscribing, email us and we will refund the payment for that first period, less a proportionate amount for the access you have had.

Business customers do not have a statutory right to cancel.

6. If something is wrong

If a download is faulty, does not match its description, or a subscription Tool does not work as described, contact us and we will fix or replace it. If we cannot, we will give you a refund. This does not affect your statutory rights.

7. Delivery and access

Download links are provided immediately after payment and by email. Subscription access is given through your member account as soon as payment is confirmed.

8. Liability

Our liability is set out in the Terms of Use. In particular, the Tools give estimates for guidance and must be checked by a competent person before being relied on.

9. Law and disputes

These terms are governed by the law of England and Wales. Consumers living in Northern Ireland or Scotland may also bring proceedings in their local courts. Please contact us first so we can try to resolve any problem.
