These terms apply to your use of www.peterkdesign.co.uk, including our free and subscription calculation tools, spreadsheets and scripts (together, the “Tools”). By using the site or the Tools you agree to them. If you buy a subscription or download, our Terms of Sale also apply.

1. Who we are

2. Engineering disclaimer

The Tools are aids to calculation for use by suitably qualified and competent people. They are based on published methods and typical data, which are simplified and may not suit every situation. Results are estimates for guidance only.

The Tools do not replace professional design, judgement or checking. You are responsible for the inputs you use, for checking results against the relevant standards, regulations, manufacturers’ data and project requirements, and for any design, installation, tender or decision based on them. Using the Tools does not create a consultancy or client relationship with us.

3. Licence to use the Tools

We grant you a personal, non-exclusive, non-transferable licence to use the Tools you have access to for your own work, including work for your clients. Subscription Tools may only be used by the named account holder; logins must not be shared.

You must not, and must not allow anyone else to:

  • copy, reproduce, publish, resell, sublicense or distribute the Tools, or any spreadsheet, script, code, formula or data from them, except for reasonable printouts or exports of your own results;
  • remove or bypass sheet protection, passwords, licence notices or access controls;
  • decompile, reverse engineer or extract the logic of the Tools to make a competing product, except where the law expressly allows it;
  • use automated means to access or scrape the site or the Tools; or
  • use the Tools unlawfully or in a way that could damage the site or other users.

We may suspend or end your access if you break these terms.

4. Intellectual property and trade marks

The Tools and everything on this site – including software, code, spreadsheets, Dynamo and other scripts, calculation methods as implemented, text, layouts, graphics and branding – are owned by or licensed to Peter K Design Ltd and are protected by copyright, database rights and other intellectual property laws. All rights are reserved.

“Peter K Design”, “PKD”, “PKD Pro Tools” and the names of our Tools are trade marks of Peter K Design Ltd, whether registered or not. You may not use them, or anything confusingly similar, in connection with any product or service without our written permission.

Results you generate with the Tools for your own projects belong to you.

5. Availability and changes

We aim to keep the site and Tools available and accurate, and we may update, improve or withdraw Tools from time to time. We do not guarantee the site will always be available or free of errors or viruses; use your own protection software.

6. Our liability

Nothing in these terms limits liability for death or personal injury caused by negligence, fraud, or anything else that cannot be limited by law. Nor does it affect your statutory rights as a consumer.

Subject to that: the free Tools are provided “as is”; we are not liable for any loss arising from use of, or reliance on, the site or the Tools, including loss of profit, business, contracts or data, or any indirect or consequential loss; and our total liability to you in connection with the site and the Tools is limited to the amount you paid us for the Tools in the 12 months before the claim.

8. Law and disputes

These terms are governed by the law of England and Wales, and the courts of England and Wales have jurisdiction. If you are a consumer living in Northern Ireland or Scotland, you may also bring proceedings in your local courts and keep the protection of your local law.
